Swimming Pool/Spa
The County regards a Swimming Pool/Spa as a form of accessory use, which the County defines as being a use customarily incidental, appropriate, and subordinate to the principal use of land or buildings located upon the same lot.
To determine the type of planning permit required for a proposed swimming pool/spa, you must determine if your project site is located in a coastal or non-coastal area. For project sites located in non-coastal areas, swimming pools/spas must conform to sections 8106-5.5 and 8106-5.13 of the Non-Coastal Zoning Ordinance to be permitted on all Open Space, Agricultural, Rural, and Residentially zoned parcels. However, for coastal area locations, swimming pools/spas are permissible on condition of conformity to Section 8175-4.15 of the Coastal Zoning Ordinance. Swimming Pools/Spas, which are located in the coastal and non-coastal zones and meet the requirements in the Non-Coastal Zoning Ordinance, require the issuance of a Zoning Clearance. Please fill out a Zoning Clearance Application and bring this with a set of site plans (include one set of 8.5” 11” reductions) to the Planning Public Counter at the County Government Center.
